Terms of service

These Terms form a contract between you (the "User") and the operator of AskFor.Music (the "Platform"). They apply to anyone who accesses the Service, whether acting as an organizer (looking for a musical performance), an artist (offering one) or a visitor.

Using the Service constitutes full acceptance of these Terms. When you create an account, you expressly accept them, together with the privacy policy: the date and version accepted are recorded. If you do not accept them, you must not use the Service.

AskFor.Music is an online platform connecting event organizers with artists and music groups. The Platform lets users publish profiles and events, exchange messages, apply to events, make bookings and process the related payments through a third-party provider (see "Bookings and payments").

Creating an account requires a valid email address. You agree to provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for all activity carried out through your account.

The account is strictly personal. The Service is reserved for people aged 18 or over with the legal capacity to contract; a legal entity is represented by a person authorised to bind it.

AskFor.Music acts solely as a technical intermediary. The Platform facilitates the connection and payment processing but is not a party to the service contract entered into between the organizer and the artist.

The Platform provides no musical performance, does not guarantee that a booking will be concluded or properly performed, and is not involved in negotiating the terms agreed between users (date, venue, duration, repertoire, fee). The service contract and its performance are the sole responsibility of the organizer and artist concerned.

When an organizer accepts the application of a solo artist who has enabled online payment, they can pay the agreed fee on the Platform. Payment is processed by our provider Stripe and collected directly into the artist's payment account; AskFor.Music never holds the funds and never has access to card numbers. With a band, or an artist without online payment, the fee is settled directly between the parties.

The amount due is the fee accepted by the organizer, plus the processing fees described under "Service fees". The organizer receives a confirmation email that serves as proof of payment; a formal invoice is requested from the artist.

AskFor.Music charges no commission on fees. When an online payment takes place, the artist collects the fee directly into their own payment account (they are the beneficiary and the merchant of record); AskFor.Music never holds the funds at any point. Payments are operated by our provider Stripe and AskFor.Music acts solely as a technical intermediary. Stripe’s processing fees are borne by the organizer and added on top of the amount paid, so that the artist receives their full fee; these fees go to the payment provider, not to AskFor.Music. At checkout, the organizer may optionally add a free, voluntary donation to support AskFor.Music; this donation is never taken from the artist’s fee and remains entirely at the payer’s discretion.

Cancellation terms are agreed between the organizer and the artist, preferably in writing in the Platform's messages, before the booking is confirmed. Failing a specific agreement:

• the party who cancels informs the other without delay, by cancelling the event or requesting the cancellation of the booking on the Platform;
• if the artist cancels, they refund in full any amount received for the cancelled performance;
• if the organizer cancels after paying online, any refund is settled with the artist, who received the funds; Stripe's processing fees are generally not returned by the provider;
• if a party does not show up on the day, the other party can report it on the Platform; AskFor.Music may then suspend the account concerned, financial claims remaining governed by the contract between the parties.

In particular, you agree to:

• use the Service in accordance with the law and these Terms;
• publish only accurate and lawful content that you have the rights to;
• not impersonate anyone or circumvent the Platform's payment mechanisms;
• not publish defamatory, misleading, discriminatory content or content infringing third-party rights.

You retain your rights in the content you publish (profiles, photos, descriptions, reviews) and grant AskFor.Music a non-exclusive, royalty-free licence to host and display it as part of the Service. Reviews must reflect a genuine experience; the Platform may remove any content that is manifestly unlawful or in breach of these Terms.

AskFor.Music uses reasonable means to keep the Service available and secure, without guaranteeing it will be uninterrupted or error-free. To the extent permitted by applicable law, the Platform cannot be held liable for damages arising from the performance or non-performance of the service contract between users, nor for indirect damages.

You may close your account at any time from your profile, under "My account"; if a booking is coming up, it must first be cancelled or have taken place. AskFor.Music may suspend or terminate an account in the event of a breach of these Terms, fraudulent use or a threat to the security of the Service, without notice where the seriousness warrants it.

The AskFor.Music brand, logo, interface and the elements of the Service are protected. Nothing in these Terms transfers those rights.

AskFor.Music may amend these Terms. The applicable version is the one in force when you use the Service. In the event of a material change, users will be informed by an appropriate means.

These Terms are governed by Swiss law. Subject to mandatory consumer-protection provisions, any dispute relating to the Service falls within the jurisdiction of the courts of the operator's registered seat, in Switzerland.
