Terms of service

These Terms form a contract between you (the "User") and the operator of AskFor.Music (the "Platform"). They apply to anyone who accesses the Service, whether acting as an organizer (looking for a musical performance), an artist (offering one) or a visitor.

Using the Service constitutes full acceptance of these Terms. If you do not accept them, you must not use the Service.

AskFor.Music is an online platform connecting event organizers with artists and music groups. The Platform lets users publish profiles and events, exchange messages, apply to events, make bookings and process the related payments through a third-party provider (see "Bookings and payments").

Creating an account requires a valid email address. You agree to provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for all activity carried out through your account.

The account is strictly personal. You must have the legal capacity to contract in order to use the Service.

AskFor.Music acts solely as a technical intermediary. The Platform facilitates the connection and payment processing but is not a party to the service contract entered into between the organizer and the artist.

The Platform provides no musical performance, does not guarantee that a booking will be concluded or properly performed, and is not involved in negotiating the terms agreed between users (date, venue, duration, repertoire, fee). The service contract and its performance are the sole responsibility of the organizer and artist concerned.

When an organizer accepts an application, payment of the agreed fee is processed by our payment provider Stripe, which handles collection, secure card-data processing and the transfer of funds to the artist. AskFor.Music never has access to card numbers.

The amount due is the fee accepted by the organizer. Refund and cancellation terms are specified at the time of booking; otherwise they are a matter of agreement between the organizer and the artist.

In consideration for providing the Service, AskFor.Music may charge a commission or service fee on transactions made through the Platform. Where applicable, the amount or rate is shown transparently before the payment is confirmed.

In particular, you agree to:

• use the Service in accordance with the law and these Terms;
• publish only accurate and lawful content that you have the rights to;
• not impersonate anyone or circumvent the Platform's payment mechanisms;
• not publish defamatory, misleading, discriminatory content or content infringing third-party rights.

You retain your rights in the content you publish (profiles, photos, descriptions, reviews) and grant AskFor.Music a non-exclusive, royalty-free licence to host and display it as part of the Service. Reviews must reflect a genuine experience; the Platform may remove any content that is manifestly unlawful or in breach of these Terms.

AskFor.Music uses reasonable means to keep the Service available and secure, without guaranteeing it will be uninterrupted or error-free. To the extent permitted by applicable law, the Platform cannot be held liable for damages arising from the performance or non-performance of the service contract between users, nor for indirect damages.

You may close your account at any time. AskFor.Music may suspend or terminate an account in the event of a breach of these Terms, fraudulent use or a threat to the security of the Service, without notice where the seriousness warrants it.

The AskFor.Music brand, logo, interface and the elements of the Service are protected. Nothing in these Terms transfers those rights.

AskFor.Music may amend these Terms. The applicable version is the one in force when you use the Service. In the event of a material change, users will be informed by an appropriate means.

These Terms are governed by Swiss law. Subject to mandatory consumer-protection provisions, any dispute relating to the Service falls within the jurisdiction of the courts of the operator's registered seat, in Switzerland.
